medical practice, behavioral-health provider, pharmacy, counseling service, peer-certification

authority, crisis-response service, or emergency service.

Account Registration and Security

Accurate information

You agree to provide accurate, current, and complete information and to update it when necessary.

Usernames, profile names, photos, and other information must not mislead people about your identity

or affiliation.

Personal responsibility

Unless a feature expressly permits an organizational or managed account, an account is for the

individual who registered it. You may not sell, rent, transfer, sublicense, or share account access.

Security

You are responsible for maintaining the confidentiality of your login credentials and for

activity conducted through your account. Use a strong, unique password, sign out of shared devices,

and notify us promptly through the Contact page if you suspect unauthorized access.

We may require password resets, identity checks, email verification, multi-factor authentication,

or other reasonable security steps. You may not bypass security controls or help another person do so.

6

Privacy and Personal Information

Our Privacy Policy explains how ClearMorrow collects, uses, stores, shares, and protects personal

information. By using the Service, you acknowledge that information will be handled as described in

the Privacy Policy and in any privacy settings made available to you.

You are responsible for deciding what information to disclose. Do not post government

identification numbers, financial credentials, full medical records, exact home addresses,

passwords, or another person’s private information unless a specific feature is designed and

authorized for that purpose.

Important: A social-media post, profile, comment, group

post, or direct message is not automatically medically confidential merely because it discusses

health, treatment, recovery, medication, or other sensitive matters.

7

Your Content, Ownership, and License

Your ownership

As between you and ClearMorrow, you retain ownership of original text, photos, videos, audio,

comments, profile information, and other material you submit, upload, post, transmit, or otherwise

make available through the Service (“User Content”).

License you grant to ClearMorrow

By submitting User Content, you grant ClearMorrow a worldwide, non-exclusive, royalty-free,

transferable, sublicensable license to host, store, reproduce, process, adapt for technical purposes,

format, publish, display, perform, distribute, and otherwise use that User Content only as reasonably

necessary to operate, secure, improve, promote, and provide the Service, subject to your privacy

settings and applicable law.

This license allows ordinary functions such as displaying a post to authorized users, creating

thumbnails, compressing files, delivering content across devices, maintaining backups, detecting

abuse, and displaying limited previews or promotional examples where permitted.

Your promises about User Content

  • You own the User Content or have all permissions required to post it and grant this license.

  • Your content does not violate another person’s copyright, trademark, privacy, publicity,

contractual, or other rights.

  • Your content is not unlawful, fraudulent, malicious, or prohibited by these Terms.

  • You obtained appropriate consent before posting identifiable information, images, recordings,

or private communications involving another person.

Deletion and retention

You may delete certain User Content using available tools. Deleted content may remain temporarily

in backups, security logs, legal records, reports, cached copies, content shared by others, or

systems where immediate deletion is not technically feasible. Some records may be retained for

safety, fraud prevention, legal compliance, dispute resolution, or enforcement.

8

Content Visibility and No Guarantee of Confidentiality

Information you share may be visible to other members, group participants, the public,

administrators, moderators, service providers, or other audiences depending on the feature and

privacy settings.

  • Other users may save, copy, screenshot, quote, download, reshare, or preserve information you post.

  • Privacy settings reduce visibility but cannot guarantee that content will remain confidential.

  • Administrators or moderators may access content when reasonably necessary for support, safety,

moderation, security, or legal compliance.

  • Messages and group discussions should not be treated as privileged, medically confidential, or

guaranteed private communications.

Post only information you are comfortable sharing with the intended audience and potentially beyond it.

9

Community Standards and Prohibited Conduct

You agree not to use ClearMorrow to engage in, facilitate, encourage, or attempt any of the following:

  • Harassment or abuse: bullying, stalking, intimidation, repeated unwanted contact, humiliation, coercive control, or targeted harassment.

  • Threats or violence: credible threats, encouragement of violence, or conduct placing another person in reasonable fear of harm.

  • Sexual exploitation: nonconsensual intimate material, coercion, trafficking, sexual services, or any sexual content involving a minor.

  • Hate or dehumanization: attacks, slurs, exclusion, or degrading content targeting protected or vulnerable groups.

  • Self-harm encouragement: coaching, celebrating, or providing instructions for suicide, self-injury, overdose, or other serious self-harm.

  • Illegal drug or medication activity: selling, trading, diverting, or helping obtain illegal drugs, controlled medication, or fraudulent prescriptions.

  • Fraud or scams: phishing, impersonation, romance scams, deceptive fundraising, payment fraud, identity theft, pyramid schemes, or false investments.

  • Privacy violations: doxxing, exposing confidential records, posting private contact details, or sharing another person’s medical or treatment information without permission.

  • Intellectual-property abuse: posting material you do not have permission to use or repeatedly infringing another person’s rights.

  • Platform abuse: spam, fake engagement, automated account creation, scraping, unauthorized bots, malware, denial-of-service activity, or bypassing restrictions.

  • Illegal or dangerous activity: using the Service to plan, advertise, coordinate, conceal, or profit from unlawful conduct or serious safety risks.

We may consider context, intent, severity, likelihood of harm, repeated conduct, and applicable law. Content may violate these Terms even when it does not violate criminal law.

10

Member Safety and Offline Interactions

ClearMorrow does not guarantee the identity, background, health status, treatment status, recovery status, intentions, statements, qualifications, or conduct of any member. Any verification or profile badge is not a background check and does not eliminate risk.

  • Do not send money, financial credentials, medication, identification documents, or valuable property to people you meet through the Service.

  • Be cautious when someone pressures you to move immediately to private channels or asks for secrecy.

  • When meeting offline, choose a public place, arrange your own transportation, tell a trusted person your plans, and leave if you feel unsafe.

  • Do not rely solely on a profile, badge, mutual connection, group membership, or personal story as proof that someone is trustworthy.

  • Report suspicious, exploitative, threatening, or fraudulent behavior promptly.

You are responsible for your interactions with other users. ClearMorrow is not responsible for agreements, transactions, meetings, relationships, injuries, losses, or disputes between members, except where responsibility cannot legally be excluded.

11

Moderation, Enforcement, and Reports

ClearMorrow may, but is not required to, review, screen, monitor, restrict, label, remove, preserve, or disclose User Content or account information when reasonably necessary to enforce these Terms, investigate reports, prevent fraud, protect safety, maintain security, comply with valid legal process, or preserve the integrity of the Service.

Enforcement may include warnings, reduced distribution, content removal, feature restrictions, temporary suspension, permanent termination, device or network blocking, record preservation, and referral to appropriate authorities.

We may make mistakes and are not required to provide an appeal in every matter. When an appeal process is available, you agree to use it honestly and not submit abusive or repetitive appeals.

12

Copyright and Intellectual-Property Complaints

If you believe material on ClearMorrow infringes your copyright, submit a written complaint through the ClearMorrow Contact page with the subject line Copyright Notice.

Your complaint should identify the copyrighted work, the allegedly infringing material and its location, your contact information, and include your physical or electronic signature.

It should also state that you have a good-faith belief the use is not authorized and that the information is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner.

Knowingly submitting a false complaint may create legal liability. A person whose content was removed may submit a counter-notice where permitted by law. ClearMorrow may terminate accounts of repeat infringers in appropriate circumstances.

13

ClearMorrow Intellectual Property

The Service, excluding User Content, is owned by or licensed to ClearMorrow. This includes software, design, layout, logos, names, graphics, databases, features, and original content.

We grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Service as intended. You may not copy, sell, license, modify, distribute, create derivative works from, or commercially exploit protected portions of the Service without written permission.

14

Third-Party Services and Links

The Service may contain links, integrations, embeds, advertisements, payment tools, or content operated by third parties. ClearMorrow does not control and is not responsible for third-party services, products, security, availability, content, or privacy practices.

Your use of a third-party service is governed by that provider’s terms. A link or integration does not mean ClearMorrow endorses the provider. Review third-party terms before sharing information or completing a transaction.

15

Paid Features, Subscriptions, and Purchases

If ClearMorrow offers paid features, pricing, renewal terms, taxes, cancellation rules, and refund eligibility will be disclosed before purchase. You authorize the applicable payment provider to charge the payment method you select.

Unless required by law or stated at purchase, charges are nonrefundable after the paid service is delivered. You are responsible for cancelling recurring services before renewal. We may change future prices with advance notice where required.

16

Service Communications and Electronic Notices

You consent to receive account, security, moderation, transactional, and legal communications electronically, including by email, website notice, or in-account notification. These messages may be necessary to provide the Service and may not be optional.

Where permitted, you may separately choose whether to receive promotional messages and may unsubscribe using the instructions provided. You are responsible for keeping your contact information current.

17

Availability, Maintenance, and Changes

We may add, remove, limit, suspend, update, redesign, or discontinue any part of the Service. Maintenance, technical problems, security incidents, provider failures, or events outside our control may cause interruptions or loss of functionality.

We do not guarantee uninterrupted, error-free, secure, or permanent availability. You are responsible for keeping copies of important content and information you post or store through the Service.

18

Account Suspension, Termination, and Deletion

You may stop using ClearMorrow at any time and may request account deletion using available settings or the Contact page. Deletion may not remove content that others have copied, reshared, or independently stored.

ClearMorrow may restrict, suspend, or terminate access without advance notice when reasonably necessary because of a Terms violation, safety concern, fraud, security risk, legal requirement, prolonged inactivity, nonpayment, or discontinuation of the Service.

After termination, provisions that by their nature should survive will remain effective, including ownership, licenses already required for retained records, disclaimers, limitations of liability, indemnification, dispute terms, and general provisions.

19

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied. ClearMorrow disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, quiet enjoyment, and warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, accurate, complete, free of harmful components, or suitable for your needs. We do not endorse or guarantee User Content, member statements, identities, qualifications, offers, products, advice, relationships, or transactions.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent legally permitted.

20

Limitation of Liability

To the maximum extent permitted by law, ClearMorrow and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, opportunities, goodwill, or data; personal decisions based on User Content; or harm arising from member interactions.

To the maximum extent permitted by law, the total aggregate liability of the ClearMorrow parties for claims arising from or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid ClearMorrow during the 12 months before the event giving rise to the claim or (b) one hundred U.S. dollars ($100).

These limitations apply regardless of the legal theory and even if a remedy fails its essential purpose. They do not limit liability that cannot lawfully be excluded or limited.

21

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ClearMorrow and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, damages, losses, liabilities, judgments, costs, and reasonable legal fees arising from your User Content, your violation of these Terms, your unlawful use of the Service, your violation of another person’s rights, or your interactions and transactions with other users.

ClearMorrow may control the defense of a covered claim, and you agree to cooperate reasonably. You may not settle a claim imposing liability or obligations on ClearMorrow without written consent.

22

Disputes, Governing Law, and Venue

Informal resolution

Before filing a lawsuit, you and ClearMorrow agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution through the Contact page. Either party may proceed after 30 days if the dispute is not resolved.

Governing law

These Terms and disputes arising from them or the Service are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where federal law applies or applicable consumer law requires otherwise.

Courts

Unless applicable law requires another location, the parties consent to the personal jurisdiction of state or federal courts serving Washington County, Maryland. Either party may bring an eligible individual claim in small-claims court.

Nothing in this section prevents either party from seeking urgent temporary or injunctive relief to protect safety, security, confidential information, or intellectual-property rights.

23

Changes to These Terms

We may update these Terms to reflect changes in the Service, law, safety practices, technology, or business operations. The revised Terms will show a new effective date.

When changes are material, we may provide additional notice through the Service, by email, or by another reasonable method. Continued use after the revised Terms take effect means you accept them. If you do not agree, you must stop using the Service and may request account deletion.

24

General Provisions

  • Entire agreement: These Terms, the Privacy Policy, and any feature-specific terms form the entire agreement regarding the Service.

  • Severability: If a provision is unenforceable, it will be modified only as much as necessary, and the remaining provisions will continue.

  • No waiver: Failure to enforce a provision is not a waiver of the right to enforce it later.

  • Assignment: You may not transfer these Terms without written permission. ClearMorrow may assign them as part of a merger, financing, reorganization, sale, or transfer of the Service.

  • No agency: These Terms do not create a partnership, employment, fiduciary, franchise, joint-venture, or agency relationship.

  • Headings: Section titles are for convenience and do not limit the meaning of a provision.

  • Force majeure: ClearMorrow is not responsible for delay or failure caused by events reasonably beyond its control.

  • Language: If a translated version conflicts with the English version, the English version controls to the extent permitted by law.
